1. Introduction and Acceptance of Terms
Welcome to Opinly, a research panel operated by Marketing Systems Group (“MSG”). By registering as a member, participating in surveys, or otherwise using the Opinly platform, you are entering into a legally binding agreement with MSG and agreeing to these Terms & Conditions, along with our Privacy Policy.
Opinly is designed to connect individuals and households with research opportunities that help organizations better understand people’s experiences, opinions, and behaviors. Your participation is entirely voluntary, and you may choose to engage as much or as little as you prefer.
From time to time, MSG may update these Terms to reflect changes in legal requirements, technology, or how the panel operates. When that happens, updates will be posted on the Opinly website. Your continued participation after such updates indicates your acceptance of the revised Terms.
2. Eligibility and Participation
Membership in Opinly is generally limited to individuals who are at least 18 years of age, or to parents or legal guardians who provide consent on behalf of a minor where applicable. In certain studies, both a parent and a teen may be invited to participate, and in those cases, parental consent will always be required before a minor is included.
When you join Opinly, you agree to provide accurate and complete information about yourself and your household. This information helps ensure that research results are meaningful and representative. You also agree to keep your information up to date over time. If information provided is found to be inaccurate, misleading, or intentionally false, MSG reserves the right to suspend or terminate your membership.
Participation in Opinly is limited to one account per individual. Creating multiple accounts or attempting to participate under different identities is not permitted and may result in removal from the panel and forfeiture of any incentives.
3. Nature of the Relationship
As an Opinly panel member, you may be invited to participate in surveys, interviews, or other research activities conducted online, by phone, or through other channels. These invitations are based on research needs, and not all members will qualify for every study.
Participation is voluntary, and you are free to decline any invitation. When you do participate, you may receive incentives such as points, gift cards, or cash equivalents. These incentives are the only compensation provided for your participation and are not transferable.
Your relationship with MSG is that of a voluntary research participant. Participation does not create any employment, agency, or partnership relationship.
4. Data Collection, Use, and Privacy
MSG collects and uses information about you in order to conduct research and manage the Opinly panel effectively. This may include information you provide during registration, demographic details, survey responses, and certain technical information related to your device or participation behavior.
Your data is used primarily for research purposes, including generating aggregated insights, improving research methodologies, and helping clients better understand populations and trends. In some cases, and only where permitted and appropriate, MSG may enhance research data by combining it with information from trusted third-party providers such as Experian or TransUnion. These linkages are conducted under strict privacy and contractual controls and are used solely for statistical and research purposes. They do not affect your credit score or financial standing.
All data is handled in accordance with applicable privacy laws and MSG’s internal data protection standards.
5. Your Privacy Rights
Depending on where you live, you may have certain rights regarding your personal data under laws such as the California Consumer Privacy Act and its updates, as well as other U.S. state privacy laws and, where applicable, the General Data Protection Regulation.
These rights may include the ability to request access to your data, correct inaccurate information, request deletion of your data, or limit how certain types of information are used. MSG provides mechanisms to exercise these rights, and you may contact support@opinly.io at any time to submit a request.
6. Consent and Communications
By joining Opinly, you agree to be contacted by MSG for research purposes. This may include email invitations, phone calls, text messages, or other forms of communication related to surveys and panel participation. You may opt out of these communications at any time, either through the unsubscribe options provided or by contacting support.
If a study involves more advanced forms of data collection, such as passive measurement or data linkage, additional consent will be requested at the time of the study. Participation in such activities is always optional and clearly explained.
For studies involving minors, parental or guardian consent is required, and parents maintain the right to withdraw their child’s participation at any time.
7. Data Security and Retention
MSG takes the security of your information seriously and uses industry-standard safeguards to protect it. These include technical, administrative, and physical measures designed to prevent unauthorized access, disclosure, or misuse.
Your information is retained only for as long as necessary to support research purposes, comply with legal obligations, and maintain the integrity of the panel. When data is no longer needed, it is securely deleted or de-identified.
8. Panel Integrity and Responsible Participation
To ensure the quality and reliability of research, MSG actively monitors participation for consistency and authenticity. You agree to participate thoughtfully and honestly, and not to attempt to manipulate surveys, use automated tools, or otherwise interfere with the research process.
If unusual or fraudulent activity is detected, MSG may investigate and take appropriate action, including suspension or termination of your account and forfeiture of incentives.
9. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, you should contact support immediately.
MSG is not responsible for losses resulting from unauthorized access caused by failure to safeguard your login information.
10. Intellectual Property
All content provided through Opinly, including surveys, materials, and platform features, is owned by Marketing Systems Group or its partners and is protected by applicable intellectual property laws. You may not copy, distribute, or disclose survey content or materials without prior written permission.
11. Third-Party Services
Opinly may include links to or integrations with third-party platforms. While MSG works with reputable partners, it does not control or assume responsibility for third-party content or practices. Your use of such services is subject to their respective terms and policies.
12. Disclaimers and Limitation of Liability
Opinly is provided on an “as is” and “as available” basis. While MSG strives to provide a reliable and secure platform, it does not guarantee uninterrupted access or error-free operation.
To the fullest extent permitted by law, MSG is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Any direct liability is limited to the value of incentives earned through participation.
13. Termination
MSG reserves the right to suspend or terminate your membership at any time, including in cases of violation of these Terms, inactivity, or operational needs. You may also choose to leave the panel at any time by contacting support.
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania. Any disputes arising from these Terms or your participation in Opinly will be subject to the jurisdiction of courts located in Pennsylvania.
